Grainne tells us all about the case of Mohammed Younis
The Supreme Court recently overturned a High Court judgement in the Mohammed Younis case.
Mohammed Younis worked in restaraunt for 7 years , he worked 80 hours a week for .55 cents an hour. His employer confiscated his passport, refused to renew his work permit and even denied Mohammed holidays, only giving him Chritmas day off.
Upon learning of the situation the MRCI supported Mohammed in taking a case to the rights commissioner , which he won and was awarded over €90,000 in unpaid wages.
In 2012, a High Court judgement overturned the award on the grounds that “an undocumented worker cant have a valid contract”. The Supreme Court has now overturned this decision.
